A cash discount program gives customers a lower price when they pay with cash or check. Your posted prices are the card prices, and customers who pay with cash or check receive a discount at checkout. Surcharging, on the other hand, adds an extra fee when a customer pays with a credit card. With our Cash Discount Program, you keep more of every sale without adding a fee at checkout.
California Civil Code §1748.1 generally prohibits merchants from adding a surcharge to customers who pay by credit card. California's SB 478, the Honest Pricing Law effective July 2024, requires businesses to advertise the full price including all mandatory fees and prohibits hidden junk fees. At the federal level, Regulation Z (Truth in Lending Act) requires that any credit card surcharge be clearly disclosed before checkout and generally limits the surcharge to the merchant's actual cost of accepting the card. Because California's surcharge ban remains in effect, most California businesses cannot add a credit card surcharge, but they can offer a compliant cash discount program. We recommend reviewing your specific situation with a qualified attorney.
